AUSGO 4WD Accessories is operated by AUSGO 4X4 Accessories Pty Ltd (ABN 20 660 311 802) (“AUSGO”, “we”, “us” or “our”).

These Terms of Service govern your use of ausgo4wd.com.au and purchases made through our online store. Please read them together with our Delivery Policy, Returns Policy and Privacy Policy.

Our online store is hosted on Shopify, which provides the e-commerce platform we use to sell our products.

1. Using Our Website

You must use our website lawfully and must not:

• Provide false or misleading information.
• Use another person’s account or payment details without authorisation.
• Upload malicious code or interfere with website security or operation.
• Infringe intellectual property rights.
• Submit unlawful, abusive or fraudulent content.

If you create an account, you are responsible for keeping your login details secure and notifying us of any suspected unauthorised access.

We may restrict access where reasonably necessary to address fraud, security risks, unlawful activity or a serious breach of these Terms. This does not remove your rights relating to existing purchases.

2. Product Information and Vehicle Compatibility

We take reasonable care to provide accurate product descriptions, images, specifications and compatibility information.

Please check the vehicle make, model, year, variant and any exclusions listed on the product page before ordering. Compatibility may also depend on seating configuration, body style, factory equipment or vehicle modifications.

If you’re unsure whether a product is suitable, contact us before purchasing and provide accurate vehicle details so we can assist.

Product colours may appear different depending on your screen. Minor packaging or branding details may also vary between production batches. These variations do not override the product description or your consumer rights.

If a product supplied differs materially from its description or our compatibility advice, please contact us so we can assess and resolve the issue.

3. Prices, Payments and Promotions

Prices are displayed in Australian dollars unless otherwise stated. GST, where applicable, is included in consumer prices unless clearly indicated otherwise.

Applicable delivery charges and any other charges will be shown before you complete payment.

We may change prices and promotions for future orders. A later price change does not alter the price of an order we have already accepted.

Discount codes and promotions are subject to their stated conditions, including eligibility, exclusions and expiry dates. Whether offers can be combined depends on the conditions of the relevant promotion.

You must be authorised to use the payment method provided. Orders may be subject to payment verification or reasonable fraud checks.

4. Orders, Availability and Cancellations

After you place an order, we will send an order acknowledgement. This confirms receipt of your order but does not, by itself, confirm that every item is available or that the order has been accepted.

We accept your order when we confirm acceptance or dispatch the goods, whichever occurs first.

Before acceptance, we may decline an order for a reasonable reason, including unavailable stock, an obvious pricing or listing error, unsuccessful payment, or a reasonable concern about fraud.

If an issue affects your order, we will contact you as soon as reasonably practicable to explain the issue and available options. We will not charge a higher price or substitute a materially different product without your agreement.

If we cannot supply an item and the order is cancelled, we will refund the amount paid for that item and any delivery charges attributable to it. Any cancellation after acceptance remains subject to applicable law and your rights.

If you wish to change or cancel an order, contact us promptly. We will try to assist, but changes may not be possible once processing or dispatch has progressed. This does not limit any cancellation or remedy rights available under applicable law.

5. Delivery, Pre-Orders and Click & Collect

Available delivery services, charges, estimated timeframes and collection arrangements are explained in our Delivery Policy.

Please check your delivery address and contact details carefully before completing your order.

Delivery and pre-order dates are estimates unless expressly agreed otherwise. If a significant delay affects your order, please contact us to discuss available options. Estimated timeframes do not remove any rights you may have under applicable law.

Orders may be dispatched in separate parcels or from different warehouses.

For Click & Collect, please wait for confirmation that your items are ready and follow the collection instructions provided.

Eligible products may be delivered to New Zealand. Availability, international delivery charges and any applicable import charges are addressed in our Delivery Policy.

6. Installation and Product Use

Follow the instructions applicable to your product and vehicle, including any preparation, fitting, maintenance and safety requirements.

Before installation, check the supplied components and the product’s positioning. If anything appears incorrect, damaged or unsuitable, pause installation and contact us. Avoid forcing, trimming or modifying the product while the fit is uncertain.

Where installation requires specialist skills, electrical work or equipment, use a suitably qualified installer.

Damage caused by incorrect installation, misuse, unauthorised modification or failure to follow relevant instructions may not be covered by our product warranty. We will assess the circumstances of each claim, and your statutory rights remain unaffected.

Installation instructions do not transfer responsibility to you for faults in our products, descriptions or advice.

7. Returns, Refunds and Product Warranties

Our Returns Policy explains how to request a return, exchange or refund, including the conditions applicable to change-of-mind returns.

Any voluntary change-of-mind policy is separate from your statutory rights for faulty, incorrectly described or otherwise non-compliant goods.

Any product warranty we offer is additional to your rights under applicable consumer law.

Please contact us with your order details and a description of the issue so we can assess your request and explain the next steps.

8. Consumer Rights

Our products are covered by applicable consumer guarantees, including those under the Australian Consumer Law. Nothing in these Terms limits or excludes any rights or remedies that cannot lawfully be limited or excluded.

Links do not necessarily imply endorsement. However, our use of a third-party platform, payment service or delivery provider does not remove our obligations to you as the seller.

10. Intellectual Property and Customer Content

Website content, including our branding, product photographs, text and graphics, is owned by or licensed to AUSGO unless otherwise stated.

You may use this content to browse our store and make purchasing decisions. Commercial copying, republication or use requires our permission unless otherwise permitted by law.

You retain ownership of reviews, photographs and other content you submit. By submitting content for publication on our website, you give us permission to display it and make reasonable formatting edits without changing its meaning.

We may remove content that is unlawful, abusive, fraudulent, infringes another person’s rights or discloses personal information inappropriately.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability under applicable consumer guarantees.

If circumstances outside our reasonable control affect our ability to fulfil an order, we will take reasonable steps to notify you and work towards a solution. Your rights to remedies under applicable law remain unaffected.

13. Changes, Governing Law and Other Agreements

We may update these Terms to reflect changes to our business, services or legal requirements. Updated Terms will be published on this page with a revised date.

Changes apply to future orders. An existing order remains subject to the Terms in effect when it was placed, unless a change is required by law or agreed with you. Where appropriate, we will provide notice of significant changes affecting ongoing website or account use.

These Terms are governed by the laws of Victoria, Australia, subject to any mandatory protections or rights available under other applicable laws. This does not require you to give up access to a court or tribunal available to you under applicable law.

If a provision is invalid or unenforceable, it will be treated as severed to the extent necessary, without affecting the remaining provisions.

Any separately agreed written wholesale or business terms apply to the transactions they cover. Nothing in these Terms overrides non-excludable rights or representations on which you are legally entitled to rely.
